BFCSA: Advice re EVICTIONS. Your enemy is the Bank! Sheriff and Police just doing their job.

My advice re EVICTIONS. There have been some very sad stories. People want to fight the Banks and yet will lose even more once Judgement is granted to Banks and they stay in their homes the night before eviction. You need to be packed and gone BEFORE the night of the deadline.

The moment the Sheriff contacts you, make sure you have immediatly lined up somewhere else to go.

Please heed these warnings which I have told our members time and again: Your enemy is the Bank. Sheriff and Police just doing their job.

We try our hardest to warn members: For their own sake, they must agree to being out of the home prior to the Sheriff deadline. Sheriff will normally agree to small amount of extra time if urgent issue for good reason. He is in fact your friend. Please treat him/her and the Police with respect for your own sake. Bank has no control over the court order once granted in their favour (unfairly or otherwise).

Police have orders to remove people gently to the footpath on the day and early in the morning usually. You cannot even go back inside to get clothes. Sheriff arrives with Removalists and orders to load everything up. Not easy and heartbreaking for all concerned.

Once sheriff hands out the notice and contacts that person re deadline, the borrower must immediately start packing. Usually have 5 weeks time to be out of the house. My advice is be free from the premises for last time, TWO DAYS prior to sheriff deadline. Yes the cost to you is anything from $12k to $20k and that must be paid to get one pair of shoes back. If you delay payment then cost escalates in rental of storage. People need to know this is the law and is non negotiable. That's why the enemy is the Banksters who caused all of the above. I try to save people this awful last minute experience.

Then start lobbying hard next two years, to help Labor achieve a Royal Commission into Banks and Financial Advice.......and head to claims for compensation and jail time for Banker Cartel members.
