Today and with controlled reasoning we heard why. The constitutionally controversial MPs are on track to lose their bid to stay In Parliament. The High Court will be unlikely to save their bacon. With incredible clarity The UNSW Dean of Law George Williams as always made legals arguments seem very simple for us all to understand. His speech on The Press Club today is one of the best.
Good News: The Labor Party has been around 100 years and understood the issue of citizenship is not revolving around Australian Law but rather how other the law of all other nations and their Governments view entitlement to citizenship. Where that nation has a policy of automatic right to citizenship, then you must relinquish your right (in writing and pay a fee). This must be done prior to standing for a seat in our Australian Government. The foreign nation will then either acknowledge you have no right, OR the right exists and they have accepted your formal relinquishment. Labor pollies have vetting process re the fee being paid and that condition satisfied. ALP have adhered to the s44 for many decades. In the Gallagher case her country of descent has strict ruling of application and therefore you cannot rescind that which you have not applied for. She is safe. The blame lies on the Party for those who were not fully instructed what needed to be done ie Phon and the LNP. The propaganda coming from the LNP has been breathtaking. The High Court can only rule on whether the official rescission with another nation requirement took place prior to applying to be a candidate.
Some nations specifically refer to Parents, Grandparents and Great Grandparents. The issue is one of how your own country of descent has given you the RIGHT of automatic citizenship entitlements. Had all these MPs been a member of the Australian Labor Party the ALP lawyers would have ensured you understood the legal position fully. That is why Ms Gallagher is safe. It shows how little Malcolm Turnbull knows of these laws after his years immersed in the lawlessness of Banking.
BOTTOM LINE: The High Court will only rule in the actual understanding of the current s44. That means the MPs in doubt and off to the High Court are gone and that means a trip to the GG and thankfully an early election.
Before Xmas will be a fabulous Christmas present to all bank victims. We can then all march happily to the tune of Royal Commission into Banks.
