BFCSA: Why ASIC is so loathed as A SIC JOKE by Consumers and why the process needs fixing!

A member asks ASIC to assist him in the recovery of the completed Loan Application Form, he had signed.  There are missing pages

Simple request and Task that ASICnever achieves success in, then leaves consumers fuming::

ASIC RESPONSE - What the Officer OUGHT TO have said to the bank victim Consumer:

You are asking for LAF and there are missing pages?  You wish us to help you with obtaining those missing pages?

Yes you are entitled in law to that copy and should have received the complete document at point of signing.

You are asking us to help you with the discovery of the complete document?

Yes that is an easy one.  It's part of our role to ensure consumers are given copy documents of that which you are entitled to

I as an ASIC officer have the power to ask the Bank to hand over the complete documentation relating to the Loan Application

Yes I will help you............................

INSTEAD, ASIC TURN A SIMPLE REQUEST into a full blown excuse to NOT assist the consumer, thereby assisting the banks to bury the documentation, cover up the criminal activity and protect the banks at all costs...........................then tell the consumer to buzz off.  ASIC constantly on the lookout for ways ASIC can do nothing rather than something.

Note this twaddle from the ACTUAL ASIC response TO THE VICTIM:

 

ASIC: Okay, this is the thing we have…there’s two things for now, we can’t do that unless we know what the context is, you could explain it because for them…for us to take any action, we have to know what the context is and what the issues are. So, we are not going to just go to ANZ and say “oh look, we’ve got one of these many complaints about you now. Please provide the loan documents”. It doesn’t work that way. We need to see the context, and to see if there is a breach of the law. If there’s no breach of the law then we’re not going to do anything. Second point is, even if you do provide us, you know, the explanation to us, we will assess it AND THEN we might work out or know this is not something where ASIC would take any action because it is not appropriate for us to do so.

ASIC and FOS NEED DEMOLITION TEAMS IN THERE! Neither bodies are on the side of the Consumer.
